Terms of Service - Hazy

Welcome to Hazy!

By clicking to accept this Agreement, otherwise agreeing to it, or by using Hazy products and services, you agree to accept and comply with the entire Agreement.

I. Scope of the Agreement

1.1 This Agreement is between you (the user) and Chengdu Zhengdian Technology Co., Ltd. and its affiliates (together "we") regarding your use of Hazy products and services.

1.2 "Hazy" (or "the Product") refers to the websites, mobile applications (APP), and related services we operate; "User" means any individual or organization that downloads, installs, registers, logs in, or uses (collectively "use") the Product.

1.3 The services we provide through Hazy under this Agreement ("the Services") include but are not limited to AI-powered dialogue, Q&A, and related services.

1.4 For specific services, you may need to agree to additional terms or product-specific agreements. We may also publish service rules, documentation, notices, etc. Such rules are part of the agreement between you and us, together with this Agreement and the Privacy Policy.

1.5 You must have the legal capacity to use Hazy. Minors under 18 need parental consent. As a guardian, you should guide and supervise minors' use of the Product.

1.6 You must agree to this Agreement and the Privacy Policy to use Hazy. We may modify this Agreement from time to time; updated versions will be posted on our official channels. Continued use constitutes acceptance of the modified agreement.

II. Service Content

2.1 Users must register with a valid phone number to obtain a Hazy account before using the Services.

2.2 Product features are provided by Hazy as available, including but not limited to virtual agent connection, dialogue, achievements, and customer service.

2.3 We protect your personal information in accordance with applicable laws. For how we collect and process your information, see the Privacy Policy. We do not actively collect identity information beyond what is necessary for registration. Please avoid entering personal information (e.g. real name, ID number) in optional fields; we may treat such input as general content and cannot always identify or remove it technically.

2.4 Hazy grants you a personal, revocable, non-transferable, non-exclusive, non-commercial license to use Hazy software and related services. All other rights are reserved by Hazy.

2.5 For certain features we have adopted the Value-Added Service Agreement and AI Service Notice. Please read them before using the relevant services.

III. Rules of Use

3.1 Content you transmit or publish through the Services does not represent our views or policies, and we are not responsible for it.

3.2 You must not use false identity when registering. You are responsible for keeping your account and password secure. If you discover unauthorized use, notify us promptly. We may take measures such as freezing or restricting the account and are not liable for losses except as required by law.

3.3 You must not use your Hazy account or the Services to:

(1) Violate laws or regulations, including:

• Opposing fundamental constitutional principles.
• Endangering national security, leaking state secrets, subverting state power, or undermining national unity.
• Damaging national honor or interests.
• Incitement of ethnic hatred or discrimination, undermining ethnic unity.
• Insulting or misusing the image of heroes and martyrs, denying their deeds, or glorifying aggression.
• Violating religious policy, promoting cults or superstition.
• Spreading rumors, disturbing public order or social stability.
• Promoting obscenity, gambling, violence, terrorism, or criminal conduct.
• Incitement of illegal assembly, protest, or disruption of order.
• Defamation, privacy invasion, or infringement of others' rights.
• Other content prohibited by law or regulation.

(2) Unfriendly or abusive dialogue, including:

• Personal attacks and insults.
• Cursing, discriminating, or disregarding dignity of others based on nationality, region, gender, orientation, race, disease, religion, disability, etc.
• Threats or intimidation.
• Belittling other users' character, views, or abilities.
• Sarcasm or passive-aggressive criticism.
• Dismissive or derogatory comments on others' content.
• Offensive or vulgar language.
• Prejudiced statements against the groups listed above.

(3) Malicious conduct, including:

• Posting meaningless or illegible characters or gibberish.
• Evading detection (e.g. variants, homophones) to post content that violates (1) or (2).

(4) Other conduct that violates laws, infringes others' rights, or disrupts the Product or Services.

(5) Other conduct prohibited by the Platform Self-Regulation Convention.

3.4 You are responsible for safeguarding your account and password. You are liable for all activities under your account. Do not use another user's account. If you suspect unauthorized use, notify Hazy immediately.

3.5 Without Hazy's written permission, no one may copy, collect, edit, or exploit content from Hazy (including images, text, data) or interfere with Hazy's operations.

3.6 You may request account deletion when ending use of Hazy. Conditions:

• You may only delete your own account following Hazy's process.
• You remain responsible for your conduct before deletion.

After deletion, account data and features cannot be recovered.

To delete your account, open the app: [Settings] - [Permanently delete account] and follow the instructions.

3.7 Our services are powered by generative AI. We may add identifiers or watermarks to outputs as required by law. You must clearly label AI-generated content when you use it to avoid misleading others. You bear responsibility for failure to do so.

3.8 You must not use our services to create, publish, or spread rumors or false information. When publishing AI-generated or synthetic content, you must label it clearly. You may not obscure, alter, or remove our identifiers or watermarks without our written consent.

IV. Intellectual Property

4.1 All intellectual property in Hazy software and services (software, technology, code, UI, text, images, audio, video, trademarks, etc.) belongs to us. No one may use, copy, or exploit such content without our permission.

4.2 You represent that content you upload is your own or properly licensed, does not infringe others' IP, reputation, privacy, or other rights, and you will indemnify Hazy for any loss. You grant Hazy a non-exclusive, royalty-free license to use your content to provide and improve our services and algorithms. Some content may be available for other users to use within Hazy. If you do not grant this license, do not use our services.

4.3 We do not require you to grant rights in your personal information. We will protect data security as far as technically possible; please avoid uploading identity-related content.

4.4 Hazy provides technical support for the Product and holds all rights in data and information generated in the development and operation of the software and services as permitted by law.

V. Legal Responsibility

5.1 Users shall comply with store terms regarding legal responsibility unless inconsistent with this Agreement.

5.2 If we find or receive reports of violations, Hazy may review, delete content, and impose warnings, account suspension, device or function restrictions without prior notice. We are not liable for resulting losses except as required by law.

5.3 Hazy may take action against violations at its discretion, including warnings, refusal to publish, deletion, restriction of account functions, or permanent closure. We may report to authorities and are not liable for your inability to use the account or access assets. We are not obliged to restore deleted content.

5.4 You are solely responsible for consequences of your violation of laws or this Agreement. If you harm Hazy or others, you must bear full responsibility and compensate all losses.

VI. Advertising and Promotions

6.1 You agree to receive information and promotional content from us or partners via notice, email, SMS, or in-app notification, no more than twice per day.

6.2 You may mark ads as "not interested" to reduce similar ads.

6.3 You may turn off push notifications in your device settings.

6.4 We may link to third-party sites or resources. We do not guarantee or endorse their content. If you cannot accept this, do not use Hazy.

VII. Disclaimer

7.1 Hazy may modify, suspend, or terminate the software or services for operational or security reasons at its discretion.

7.2 Services provided by AI-generated virtual agents are based on current algorithms. Hazy strives to serve you but does not guarantee: suitability for your needs; uninterrupted or error-free service; correction of all defects; or that outputs will align with your beliefs. Technology may occasionally produce offensive output without intent to infringe.

• Any express or implied warranty (e.g. fitness, non-infringement) to the extent permitted by law;
• That the software or services will fully meet your requirements or be free of harmful elements;
• Uninterrupted, timely, secure, or error-free operation;
• That all errors or defects will be corrected;
• That outputs will conform to your morals or beliefs.

Hazy reminds you that due to the nature of technology, our software and services may occasionally produce output that offends you; Hazy has no subjective intent to infringe.

If you cannot accept the above and release Hazy from liability, please do not use our services.

7.3 All virtual content (including agents and dialogue) is based on Hazy's algorithms and content. Ownership belongs to Hazy. We may manage, delete, or display your created agents and change service rules without your consent. If you cannot accept this, do not use our services.

7.4 Hazy's right to handle illegal content under this Agreement does not constitute an obligation; we cannot guarantee timely discovery or handling.

7.5 In no event shall Hazy be liable for indirect, consequential, punitive, or special damages, including lost profits. Except as required by law, our total liability shall not exceed the fees you paid to Hazy (if any) during the relevant period.

7.6 This Agreement aims to comply with laws and protect rights. Hazy will use reasonable efforts to make correct judgments but does not guarantee alignment with courts or authorities; you accept any resulting consequences.

VIII. Minor Users

8.1 You must have legal capacity to use Hazy. Minors under 18 need parental consent. Guardians should guide and supervise minors' use.

8.2 Please abide by the National Youth Online Civility Convention:

• Learn online and avoid harmful information;
• Communicate honestly and respectfully; do not insult or defraud;
• Protect yourself; do not arrange meetings with strangers;
• Maintain cybersecurity and order;
• Use the internet for healthy purposes; do not indulge in virtual space.

IX. Other

9.1 Hazy may perform maintenance causing reasonable service interruption; we will notify you in advance and are not liable for such interruption.

9.2 This Agreement is governed by the laws of the People's Republic of China (excluding conflict of laws). Disputes shall be under the jurisdiction of the courts of Chengdu High-tech Zone, Sichuan Province.

9.3 Formation, validity, performance, and interpretation of this Agreement are governed by the laws of mainland China.

9.4 Section headings are for convenience only and do not affect interpretation.

9.5 You and Hazy are independent. This Agreement does not constitute a guarantee or create agency, partnership, or employment.

9.6 We may revise this Agreement and will notify you of updates. Continued use constitutes acceptance. If you disagree, stop using Hazy.

9.7 Affiliates of Chengdu Zhengdian Technology Co., Ltd. include Shanghai Xiyu Technology Co., Ltd., among others.
